Cleveland, Ohio — The Piscitelli Law Firm obtained a $300,000 total recovery for a 78-year-old man injured in a 50 mph T-bone collision.
After the at-fault driver tendered Ohio’s $25,000 minimum limits, the firm pursued the client’s $300,000 underinsured motorist (UIM) coverage.
The client’s injuries included soft-tissue trauma (resolved) and radial tunnel syndrome – a painful compression of the radial nerve in the upper forearm that can cause aching, grip weakness, and pain with rotation.
The UIM carrier initially offered $70,000.
The firm filed suit for $275,000 (the UIM limit minus the $25,000 setoff).
Following several months of litigation, the insurer paid the full $275,000, bringing the total recovery to $300,000.
