  • The veteran died during active duty or due to a service-connected disability.

Chapter 35 educational VA benefits are also available to surviving or dependent children or spouses of a current service member who fits one of these four descriptions:

  • The service member died during active duty after September 10, 2001.
  • The service member is missing in action or was captured during active duty by a hostile force.
  • The service member was forcibly held during active duty by a foreign government or power.
  • The service member is currently hospitalized or receiving outpatient treatment for a total and permanent service-related disability and is expected to be discharged due to that disability. 

Additionally, some survivors and dependents of service members or veterans who do not meet the above criteria may still be considered for Chapter 35 VA disability benefits on a case-by-case basis.

How Can Chapter 35 VA Benefits Be Accessed?

Qualified individuals wishing to access Chapter 35 educational VA service-connected disability benefits can do so by simply applying for them.

Two ways can be done through the GI Bill:

  • Fry Scholarship - Available to qualifying spouses and children of active duty service members who died during active duty on or after September 11, 2001, or Select Reserve members who died due to a service-connected disability on or after September 11, 2001.
  • Survivors’ and Dependents’ Educational Assistance (DEA) program - Provides education and training to qualified dependents of veterans who are totally and permanently disabled due to a service-connected disability or who died during active duty due to a service-connected condition.

Some dependents or survivors may qualify for both programs. Recipients may only choose one benefit.
